The Black Box

All of our readers here at the KG Blog have probably heard of a black box. Whenever a black box is mentioned, its almost a sure bet that the discussion is centered around an airplane crash and the subsequent investigation. The black box has gained its public recognition from being an integral part of plane crash investigations. But did you know that black boxes are also utilized in the trucking industry?

As in planes, semi truck black boxes record everything from engine speed, brake application, actual vehicle speed, seat belts and airbag deployment. This means, as in airplanes, the black box largely goes unnoticed and unchecked. However, again as in airplanes, when things go wrong, the black box becomes an injured party's best chance at determining liability.

Say you are driving along I-71 from Cleveland to Columbus and you get in an accident with a semi truck outside of Mansfield. The trucks black box, once an afterthought by the driver and the trucking company, then becomes a source of material evidence. Maintaining the integrity of the black box becomes essential to the case. You, or your attorney, should insist that the black box is not destroyed, altered, or inspected by the truck company without notice and/or consent. A joint investigation with your attorney can ensure that you get all the necessary information you may need in order to successfully recover for any injuries you may suffer as a result of an accident.
